Newbie help!?

Hello all

Hope you might be able to advise.

I park in the station car park daily using RingGo.
Recently they had APCOA take over the management.

I also recently changed my car and forgot to change the reg in RingGo.

I received three charges of £85 for 3 consecutive days and appealed via APCOA, they have stated terms and conditions mean I have to have the right registration.

I’ve appealed to POPLA using other and that I paid for parking just not the right car.

Yes I know I should have posted for advice before, but is there anything I can do from here?

I’m also worried that they may send more my way as I didn’t change my registration till the day I received the fines.

Help??

Await the outcome of your POPLA appeals. You did send a separate appeal for each PCN didn't you?

If your POPLA appeals were weak (I get the impression they might have been), then they will be rejected. You are not obliged to be bound by the POPLA decision, so it's then a case of ignore anything further unless you receive a LBC or MCOL Claim (acronyms in the NEWBIES FAQ sticky, post #5).

As I write, APCOA don't issue court proceedings, despite issuing hundreds of thousands of PCNs, but they do have 6 years to pursue through the court if they change their behaviour.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

after 6 months it doesnt matter as bylaws apply, so only the TOC can take this to a Magistrates Court, so as mentioned above there wont be a court case or cases

in future, come here FIRST and never reveal who was driving

This is obviously a genuine, (but very minor), mistake, complain to your MP.

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
You never know how far you can go until you go too far.
