With Link, it may well be that the account has become statute barred, since you have not been acknowledging the debt. When does the account date from according to your statements? If applicable, then maybe send them a SB letter.

Are there any other accounts you have?

What would this letter gain me?
No other accounts that have defaulted.
  • Hi,

If all your annual statements from Link indicate that the HP debt should be Statute Barred then if it were me, I would send the SB letter. A debt can become statute barred six years after the debt was last acknowledged. If it can be proven that the debt is SB then that could be end of it!

How are you managing all your other non-defaulted debt accounts? Is it a struggle or is everything ok?

One is a HSBC loan (approx 9k) which was sold to ARROW. I have done the CCA with this one, and they have not come back to me with proof that it is enforceable? Date of default is December 2012.
The other is an HSBC credit card (approx 1600) sold to INTRUM and this defaulted in october 2013.

If they can't provide a correct CCA sourcrates can give more advice one what is and what isn't correct] then the debt is unenforceable. this mens you can stop paying it if you like. They can still e-mail you and phone you about it, but they can't take you to court about it and they have no way to force you to pay it.

Satute barred is when you havent acknowledged or paid any money to a debt for 6 years [5 in scotland]. The default date is important to this. If it is statue barred, you also do not have to pay anything towards it if you don't want to and again, they cannot take you to court over it. Also, they are not allowed to phone/e-ail you about it Once you have pointed out it's statute barred.
