    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    Do the SAR now, P/Eye have a 'privacy' page & form specially for these queries.

    And I mean...NOW.

    Ask for all images and letters sent and if they have an old address still, take this opportunity to get their DPO to rectify it & erase the old one from their records.

    Wait till next week, as a set aside next week is no different than now, and you need to know what you are defending. Also, PEye are one of the few PPCs who will consent to a set aside (court fee £100, but you also have to settle the PEye sum on top if you proceed that way) - that is, if you see the PCN and photos and can see no defence.

    At least you will be making an informed decision and as long as you show PEye your ID (the car V5C should be enough) they will probably be quite quick to send you the data, especially if you mention you are considering your options including a set aside with consent, but need to see all data to decide.

    If you can see a defence then come back here, and do the £255 set aside without consent.

    If this is a significant overstay in a retail park, you'd have little chance IMHO, but plenty of PEye cases ARE defendable - such as if the car park was pitch black at a Motorway Services, etc.

    Thank you for the advice - I contacted Parking Eye and they responded to me today with the following email. They have passed the Charge to Debt Recovery Plus (guess the clue is in the name?) However, they have never been in contact with me. Parking Eye still require the full amount to be paid!

    Please can you advise any further steps I should take? Or would it just be easier and quicker to pay the Charge/CCJ and have it 'settled' on my credit file?

    Thank you for your correspondence received in relation to the above referenced Parking Charge, which was issued following a parking event that took place on 7 July 2015 at English Gate Plaza South, Carlisle car park.

    It is clearly stated on our signs that failure to adhere to parking regulations will result in enforcement action being taken and vehicle keeper details being requested from the DVLA to enable this. The DVLA release the name and address details of a vehicle keeper to registered companies, such as ParkingEye, if ‘reasonable cause’ can be demonstrated; i.e. a breach of parking regulations.

    In this instance, 4 letters were issued prior to legal action but unfortunately, ParkingEye received no response. Our original notices outlined the appeals procedure offered by ParkingEye and provided a period of 28 days from the date of our initial correspondence to send any documentation you believe would aid an appeal to us directly. ParkingEye run a dedicated appeals team who consider each appeal on a case by case basis but we note that in this instance, no such appeal was lodged.

    ParkingEye thereafter issued a county court claim to recover the outstanding amount. However, as no defence was filed, nor was full payment received within the applicable time frame, the court granted a default judgment in ParkingEye’s favour. At this late stage, ParkingEye would be unable to accept an appeal and we require payment of the full outstanding amount.

    Please be advised the above charge has now been passed to Debt Recovery Plus, and all further correspondence should be directed to them.

    We can confirm that £200 remains outstanding. Please find our payment information below.

    If you wish to apply to have the judgment set aside then you can do so by filing an N244 form. Please note that such an application will require the payment of a court fee of £255 (payable to the court) and that there is no guarantee that the judgment will be set aside. This will also involve a hearing in front of a Judge.

A system known as the remission system is available to those who would have difficulty paying a fee and meet the appropriate criteria. It is for you to make the appropriate enquires about this system and details can be found at- *************(website)

    I used the form on the privacy page to contact them. Just found the SAR Template I will complete asap and send in. I will update as soon as poss.

    Should I be worried that Debt Recovery Plus are involved?
