    Does an IPA start after being discharged??

    No. An IPA can only be agreed while you are undischarged. Once you are discharged the OR can't set one up.

    And bear in mind, if the OR thinks there is a chance of an IPA, your discharge will almost certainly be delayed while he puts an IPA into place. You could take the job and hope you are discharged in the following three weeks, before you have to say anything to the OR. But if it doesn't come through before then, you're going to be in it for the long haul.

    EDIT: Sorry if I sound so jaded, but I am in the process of sorting out an IPA very late in the bankruptcy process. I received a payrise from my employer in August that took me above the £100 threshold, which I declared immediately. I received EDREV form the 4th September, returned them promptly. IPA paperwork was sent out 19th October, though didn't receive it until the end of October. Again, returned the forms promptly. I have just spoken to the ORs assistant to confirm she has received the paperwork - yes she has, but she now has to wait 14 days before she can send it on to the solicitors for processing. No doubt it'll be another 14 days after that before its processed and I have all the paperwork in place. And while all of this is going on, my ED obviously remains on hold. ARGGH!!

  • Hi again

    Just telephoned the OR(i couldn't resist) and he just told me that i'm up for early discharge and should be getting letters this side of xmas! They are just now waiting for objections from creditors etc but he said that they usually don't respond. What should i do with it being so close? would i be ok?

    How long have you got to decide about the job? How long before it would start, and how long before you would be paid?

    As said before, the OR must wait 35 days from when they send the letters to the creditors before they can file the ED. But that is just the earliest date they can do it. When they actually do it after that is up to them.

    Sounds to me like you don't have enough time - even if he sends you the paperwork this side you Christmas, and all goes well, you won't be discharged until next year sometime.

    It's a difficult one. Could you push your start date back a bit then with the 3 weeks you might just make it.

    How about putting up an I&E with your new monthly wage and we could have a look at it for you.

    Otherwise you are just going to have to decide how much you want this job vs chance of IPA. How will yor life change if you have a job? Write a list of pro's and con's.

    That suggests that the 35 days for objections has well and truly started Neko, plus the original/1st post implies the initial ED paperwork(IPOQ) has been done.
    I think the paperwork the the OR is referring to before Xmas will be the discharge notice (EDNOT) once it's been filed. But as said you can't guarantee that the OR's office will be able to stick to that time-scale.

  • They want me to start the job on Monday! Its also complicated cos i have also been told i will keep my child tax credit element until April, then it will drop again to around 200 cos it's a year behind etc and worked out April to April. Ok here goes..this would be my situation if i take the job based on monthly outgoings for 2 adults and 3 children:

    OH wages: 1022 (take home)
    My wages: 800 approx (take home)
    Tax credits: 372
    Child benefit: 169

    Rent: 232.36
    Housekeeping: 600
    Gas/Electric: 100
    Water: 39
    Telephone: 37
    Travel: 132
    Clothing: 100
    Council tax: 77

    Childrens expenses: 30

    School dinners: 84
    Catalogue payments: 50
    car insurance: 22

    I'm sure there's other things too but can't think! Can anyone suggest anything? Thanks for your time..you're all stars!!

    Your OH's wages can't be used for any surplus to be claimed in an IPA.

    The OR will work out your surplus as:

    Surplus = "Your income" - "Your contributions from your income towards the household expenses, and costs you meet by yourself"

    Plus Child benefit can't be included as part of your income (officially it's for the kids, not for you).
