eMoov estate agents have called in administrators

eMoov was the hybrid online/ local agency estate agents.

Today it has called in the administrators.

  • My mother in law's house was for sale with Tepilo, and got moved to the Emoov platform a couple of weeks ago. They issued the Memorandum of Sale with a wrong sale price on it, and had been asked to issue a corrected one. Now they have gone into administration, I don't know what to do. The buyer wants to get cracking, and we need to sell ASAP as the owner is very unwell and in hospital. If we don't get things sorted while she is still with us, things will get much more difficult for the family. Should we just try to get another estate agent to pick this up and try to move things along, or is it likely that the administrators will keep Emoov running for at least a short while? I appreciate that it is early days, and maybe no-one knows yet what will happen.

    If a sale is agreed then you don't really need the estate agent. In a sale where there is no chain then it should be fine to carry on just with the two parties and their solicitors.

    Estate agwnts are really only there to find the buyer. Some can be helful in making calls, chasing round and progressing the sale, but that isn't a critical role by any stretch of the imagination.

    Thanks for your reply. I appreciate that the acceptance of the offer should mean that things can move on, but the Memorandum of Sale seems to be a crucial part of the process. In this case, Emoov/Tepilo issued it with a wrong sale price on it. That means that each side has a wrong document with which to continue the transaction.

    Just type up a new one with the correct price and get both parties to sign it

    The main purpose of the memo of sale is to put the two solicitors in contact with one another. In this case your mother in law should notify her solicitor that the price on the memo is incorrect, and that the solicitor should write to their opposite number clarifying the correct price that has been agreed, and send draft contact papers showing the correct price.

    Shouldn't cause any issue.

    You don't meed the Agents. Instruct a solicitor and they will deal from now on. The only issue will be who to pay the agents fees to - probably the administrators rather than emoov itself.

    In relation to the memo of sale, all your mum's solicitor needs to do is a letter to the other side saying "emoov made a mistake on the Memorandum of sale, the correct price is £Price - please confirm that these are your instructions as well"

    Can confirm, last EA I bought through were useless and never did manage to put the memorandum together, we just gave the solicitors the details ourselves and they got on with it. It didn't cause any issues.
