Working tax credits living with parents

Hi all
I am living with my parents and am seperated from my partner although we are still legally in a civil partnership
He is living in a seperate flat in another city.
Can i claim working tax credit due to my low income , as a single person or do i have to still claim as a couple?

It depends if the separation is temporary or likely to be permanent. If the latter, then you will need to be able to evidence that if HMRC investigate.

We tried to divorce once but it was refused and we genuinely want to seperate it cost a lot of money and cant afford to try it again . I guess i would have to claim as a couple then even though we are not living in the same house?0

The test for civil partners and married couples doesn't look at whether you live in the same house - if you are civil partners who are not separated in circumstances likely to be permanent or under a court order then you have to claim as a couple even if you live in different houses.
You don't necessarily need to divorce, but you would need to take steps to show HMRC that you are separated and it is likely to be permanent (e.g. changing details on bank accounts etc...)

You'll need to check what's in your area first. If it's a full Universal credit area then you won't be able to claim tax credits. It will have to be UC. Check here http://ucpostcode.entitledto.co.uk/ucdateHi all

Good point - i assumed the OP had checked!
The rules for UC are different as they require you to be in the same household to claim as a couple.
