Hastings are pretty dodgy.

The only thing you can do in a case like this try to recover your premium increase from the pedestrian. You could use Small Claims Court if they refuse.

I would strongly recommend that you do not pursue the pedestrian

Might encourage them to make a claim against you which may or may not be successful, but why take a risk. Too much to lose. Not a good gamble in my opinion.
