It's going to be fun in November

Personally, I do not see how they could possibly prevail. Have they engaged Mrs Miller's Q.C.?

It might be Jonathan Kirk of PE v Beavis fame. He could be a handful!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Could well be.

Mr Kirk argued that the charge was reasonable as it included the costs to operate the scheme
The Supreme Court agreed hence ...

    198. ''...The charge has to be and is set at a level which enables the managers to recover the costs of operating the scheme...''

That does not cover adding charges

    Couple that to
    POFA2012
    Double recovery rules
and ..... of late from the Southampton court where DJ Taylor said he would have dismissed the case anyway for abuse of process and just the other day, Judge Giddins striking out two claims from BWL as abuse of process.

Whoever is going to support BWL in November will have to be a magician to overcome the above, especially the Supreme court

    Forgot to ask,

Will I be getting any official letter from Court about the outcome for those both claims reminding about costs to be paid by claimant to defendant as well ?

I can not remember by when Judge said those costs should be paid to me... so wondering what should I expect now...

    Thanks again
