Newham Council parking fine - help!! baliffs

Hi , help needed.

I have a parking fine from newham council. I had lent my car to a friend for 1 day ( no longer a friend) and he got a parking fine. I have been away for the past 3 months abroad, so I returned to find it was £180. I immediately contacted the council and appealed it. They came back and said that as there is no CCTV so I cant prove I wasn’t the driver and have to pay. Long story short I left it until so it has gone to Rundles bailiffs and now the balance is £270. The reason i left it was i was still trying to get the money from the friend in question without any luck (they are unemployed and have moved 300 miles away to Scotland) so I thought I would ring the bailiff company and set up a payment plan. So I did, and paid the first £80. The next £80 was due the next month ( so this month on the 24th November and I forgot to pay it, genuinely, I only was reminded ( I was 5 days late) from a letter from Rundles stating they had been to my address to collect the outstanding £190 and no one was in. I called them straight up to pay the £190 and was told it is now £500 and I must pay immediately. I havent got this kind of money, not even close. So I asked to pay half now and half next month. They refused and have given me 48 hours to pay in full other wise they will return and put it up to £750.

I havent slept worrying about it, but even if I pay £250, I will be left with £20 quid in my account, for food and train fare so it still will be hard but I could manage by calling in sick for work ( been there 4 years without a sick day) and eat basics for a week. Other option is I just don’t ever answer the door again (which some forums advise)

I have a car on HP, most probably 80% still outstanding and my agreement with the fiance company is that I don’t own the car until the last payment is cleared. Will they take my car? Will I have to move it away from my address? Even if they come round the way its parked at an angle on the drive means it would be impossible for a tow truck to get at it anyway.

I have read as it’s a county court parking fine they can’t force entry or make me pay by force.

I have no access to any other money and am on a DMP ( debt management plan) , (this was for the ex wife spending 15k on credit cards in my name) at the moment and have been for about 12 months ( all my payments for everything is up to date).

What should I do?

    I suggest you contact Bailiff Asvice Online. Sheila from there posts here as Herbie21

    I have never used them but they have a good reputation on this site.

    You may also want to post on pepipoo.com about transferring liability to the driver. You will need to register there using a non-Hotmail email account, then read the FAQs before posting your query.

  • Just rang step change and they advised me to never let them in, or even entertain it. They said to pay half the amount now, so 250 and then advise them i will pay the other 250 next month when i get paid on the 12th. If they come round which they might just dont let them in. they also advised as my cars on HP they cant take it otherwise its theft, plus they wouldn't drag it out as its unable to be put on a tow truck as it is on the drive in its current location.

    So ive just called rundles and the bailiff isn't available ( he will call me back apparently) so i asked to pay half now and the lady on the phone went away to ask and came back and said yes. So i paid half the amount.

    Also step change said no matter how many times they come round they CANT charge any more fees and Rundles saying they will put the charge up by 250 per visit is a lie and utter nonsense. Only if they enter they can put a charge on for removal of goods. ( obviously they wont enter).

    Any other advice will be helpful.

    As the PCN had reached the £180 stage, you were well outside of the time period for 'appealing' the ticket. At this stage, the notice that you received would have likely been the Order for Recovery. On receipt of the OfR, motorists are given a final opportunity to correct any earlier mistakes (such as not receiving the initial notice from the council etc).

    For this reason, attached to the Order for Recovery, would have been either a witness statement or alternatively, a statutory declaration.

    In your case, all that you would have needed to do would have been to tick the first box (I did not receive the Penalty Charge Notice) on either form and AUTOMATICALLY, the PCN would have been 'rewound' back and the council would have REISSUED you with a fresh Penalty Charge Notice allowing you the opportunity to either pay the charge at the earlier discounted rate (around £60), or alternatively; to appeal the ticket.

    PS: If you had been away for 3 months and have some sort of evidence, (and had not received the initial notice from the council when the debt was around £60), there is still a remedy available to you. You are still able to submit the statutory declaration. You will need to make what is called an 'Out of Time' application. All bailiff enforcement will then be placed 'on hold' for approx 4-6 weeks.
