Hello, since the end of February we have been receiving parking fine letters from CEF LTD for a carpark about 5 miles from where we live but we cannot remember using it, (3 drivers on insurance ) the time of the letters seemed unprofessional & & scare mongering, they keep saying they have photo evidence but hasn’t sent any, they have now told us they have a county court judgement against us & unless we pay £342 they will send the baylif’s in, is this leagal? & if they had court judgement shouldn’t we have had an official letter from court? Thanks in advance

    Did you get a county court claim form? Yes or No

    In order to get a CCJ you should have recieved a court claim form, and then after that a notice of the judgement.
  • We’ve only received mail from this firm or people acting for them, all letters seemed as if it was trying to scare old or vulnerable people so that’s why we thought it was a scam, would the form come from the court? & thanks for your help :)

    1) Contact DVLA and ask if your details have been released to CEL/any other PPC's.


    2) Send CEL a SAR which will require them to provide the photos, (and other details they have on you), within 30 days.

    OK so you did not have a claim form - this would be from the court, not CEL
    Do you have a Judgement letter? This would also have been from the court

    You need to ring the court and ask if any judgements have been entered against you, as you habve a letter from CEL stating they have one and you have NOT seen any court claim form nor a judgement in default letter, which you would expect to have seen
    They should be able to use your name and address t o look this up
    You must do this TODAY
    NOW
    They shut in 2 hours

    IF you have had a valid claim against you it is possible you were in the bunch of MCOL claims that FAILED to have a claim form sent out; if so, this was the COURTS fault and, if you let them know, they should be able to get a judge to look at this, agree a set aside, and ytou are back to square one - submitting a defence against the claim

    SO YOU MUST ACT QUICKLY - you have a very very very limited time to do this.

    So you ignored a court claim?

    Does your PC or phone not highlight that unreadable misspelling of the word 'bailiffs'?

    You will need to ring the CCBC.

    If the claim date was 13th September (ask them) the CCBC mucked up that day and somehow omitted to issue a shedload of claim forms. Maybe the issue is wider than that.

    Whether you have a CCJ or not read below and complain to your MP.

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.
