anybody help clarify this points too mant conflicting opinions, we live in spain but want to return to uknow, the property here is in her sole name ,we are in process of buying a small property in uk, we wanted it to be in joint names but been informed as she already owns a property we have to pat extra stamp duty,(2nd home) if we buy and its in my sole name do we still have to pay the extra duty? the house is going to be sold asap , we know we can get a rebate when this place is sold,but the extra tax diminishes our funds for buying considerably, any way round it please

If "her" is your wife, then yes you pay the extra SDLT no matter which of you buys. If you're not married then her property isn't relevant to purchases in your sole name.0
