Refund for Class Tickets Purchased Online

Hi,

I purchased a two tickets online for a cookery class. They are tickets for a specific date, and will involve a few hours cooking with others.

The class isn't until late January, and they were purchased just two days ago.

I've now changed my mind and don't want to go. I called the cookery school and their response was that 'we don't give refunds, only credit'. Their website states that 'Confirmed bookings may not be cancelled in any circumstances. Bookings are, however, freely transferable to another person for the same class or to another scheduled class.'

However I was under the impression that under the The Consumer Rights Act, and distance selling regulations I was entitled to a refund?

Am I now stuck with these vouchers or am I legally entitled to a refund?

    You can't cancel, the vouchers are exempt from cancellation. There are exemptions in the CRA of which this is one of them.


    You can of course give or sell them to someone else.

    (h)the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.

    The question is, would a cooking class be deemed a leisure activity. A leisure activity is typically something done for relaxation or enjoyment. While people may cook as a leisure activity, the purpose of a cooking class imo is not for leisure but for learning.

    Also, did the OP purchase tickets for that date or did they perhaps purchase with no date set and then subsequently booked a date.

    ETA: Even if deemed a leisure activity, they're only exempt from the normal cancellation period - they still have to comply with providing the necessary information (including that you will not benefit from the right to cancel) and are subject to the rest of the CCRs.

    The definition of leisure is "time when one is not working or occupied; free time". There's no requirement for it to be enjoyable or relaxing.


    I think the cooking class - whether for relaxation, enjoyment or learning - is something that the OP will be doing in their otherwise free time, and so it would constitute a leisure activity.

    That may be the definition of leisure time, but not leisure activity. Else everything you did when you weren't working/every service would be classed as a service related to a leisure activity.

    You'll note leisure also has the dictionary definition in this context of:
    1.1 Use of free time for enjoyment.
    ‘increased opportunities for leisure’
    as modifier ‘leisure activities’

    I know how to cook and would attend a cooking class for leisure. That's my opinion, though.
