boiler service / repair

I arranged to have my boiler repaired and serviced. I was obligated to pay 50% up front as a down payment for this service. The whole fee was £1062 including VAT , I have a Vaillant ecotec plus 28 boiler. This was to be an intense strip down of the boiler and service and replacement of pipes etc. He was supposed to do this today. He never showed up.

I spoke to him on the phone this evening. We both lost our temper. I wanted a refund of the deposit. He said this was impossible due to the terms and condition of the contract I had entered into with him (I had read about this clause in the quotation. We had a very heated conversation which ended with him saying he would do the job tomorrow after 1pm.

If he does not turn up am I able to get the 50% deposit back, even if I agreed to the terms of the quote? I paid by credit card.

Very stressed about this. It's a lot of money for me. It seems like his company is legit and everything. I got very frustrated that he let me down today and this was the first time I had used the company.

Any advice would be helpful.
