Online mattress purchase

Hi all,
I have just purchased a mattress online from a furniture company. It arrived vacuum packed and is described as medium. We unpacked it and allowed the several hours to settle and then tried it. I weigh approx. 13 and a half stone and made no impression in it. It was way to firm, contacted the company and all they are saying is that the hygiene seal (polythene bag) that it came in has been broken so they can't accept it back. I tried to explain that to check it, I had to open it as it came rolled up like a carpet. Am I entitled to any refund?

    They usually come in two plastic layers. The outer one and an inner hygiene layer which has warnings printed all over it that once removed the mattress cannot be returned

    Doesn't sound like you're entitled to a refund, retailers are allowed to refuse a return under the Consumer Contract Regulations where a hygeine seal has been broken.

    Your best bet is probably to resell it.

    If the "hygiene" reason really stands up (and it probably does), then have you thought of buying a soft or medium topper? My old mattress was much too firm and a topper made it really comfortable.

    Whilst Hard, Medium, Soft are somewhat subjective terms, if the OP can evidence that the mattress they received does not match the description (i.e. it really is Hard rather than the Medium ordered) then OP is entitled to return the mattress for a full refund, regardless of whether a hygiene seal has been broken.

    If the description doesn't match the goods supplied then of course you are absolutely correct. I've actually just returned a memory foam mattress described as 8" thick and suitable for adjustable beds - it was not 8" thick and I could feel the slats through the memory foam, so in my particular case it was easy to claim my refund. If the OP is unable to return their mattress though, a topper could save some very uncomfortable nights.
