Received a PCN from Civil Enforcement

Got back from holiday to find a PCN issued for overstaying the 3 hour free limit at a car park managed by Civil Enforcement. The letter was sent to the registered keeper of the car, and 'invites' the keeper to tell Civil Enforcement who the driver is. The reduced charge is £60 and rises to £100 after 28 days.

The ticket was issued after a few days, and has photos of the car apparently coming into and leaving the car park, overstaying for 30 minutes.

The driver was in one of the retail shops for the entire period, visiting the cafe and breastfeeding the baby etc and is seeking to get the ticket cancelled by talking to the shop manager. This has been to no avail so far.

I have sent an 'appeal' to CEL, using the template set out here in the newbie thread, (not detailing that the driver was in the shop, spent over £200 in the shop etc, and needed the extra time to care for the child.) I did not want to detail the driver, as I do not want to give details of the driver to CEL.

The appeal was declined by CEL, and now I have a POPLA number to carry on the appeal

Obviously, I am disgusted as the demands for payment, and have mitigation for the extra time spent in the shop.

So the question is, what is the best way to approach from now on?

    Does the postal PCN have the POFA paragraph on the back (CEL have improve them recently) and did it arrive by day 15?

  • OK, thanks for that, I will write a draft and post it on here. Yes, they do have section 4 of the POFA detailed on the back of the initial letter. It did arrive within 15 days also.

    I will read up on the pot in the newbies section.
