Notice to Keeper - payment deadline today (and driver at fault) - I have read the Newbies thread!

Hi there,
I want to pre-face this as saying I have read the Newbies thread, but still have some questions.
Basically I have received a Notice to Keeper for parking in the wrong space at a residential property. I concede that the driver did indeed park in the wrong space - the driver was visiting the driver's girlfriend in her flat and parked in a space that's always empty for about 20 minutes whilst waiting for her to get ready to go out.
I received a notice to keeper but because I didn't respond in the time frame, they sent another one (essentially identical but with a month to pay £100). Today is the last day to pay that 'invoice' - yes I know I have been an idiot and left it too late but I've been extremely busy and I basically completely forgot about it until I found it in my work bag last night.
Is this a lost cause or is there some hope that I can appeal (I've missed the 21 day deadline) or just ignore it? I would rather save £100 just before Christmas, obviously! But, as i said, I concede that the driver wasn't in the correct parking space so appreciate that may just have to suck it up and pay the cost.
Any and all help would be massively appreciated!

You need to use the Edit then Go Advanced option to edit your title. The driver was allegedly at fault.
You appeal using the template appeal from the NEWBIES.
CPMS are IPC scammers, so there is no worthwhile second stage appeal, but if it gets to court there will be numerous points to use, including wording from the driver's girlfriends lease/AST. It would be worth ensuring that the lady in question has a copy of that as early as possible.I married my cousin. I had to...I don't have a sister.

What do you mean there is no worthwhile second stage appeal? As in, they're unlikely to take it through to the second stage if I appeal?

No. The 2nd stage appeal is to the IAS ... this is a kangaroo court where you're almost guaranteed to lose, even if you had a cast-iron appeal that would be certain to win in real court. (That's why many PPCs jumped ship to the IPC ... when they were with the BPA, where the 2nd appeal was with POPLA, they were losing too many appeals which meant there were fewer people they could threaten with court action).0

Many, do they have a valid contract with the landowner, are their signs sufficient to form a ciontract, is their paperwork up to snuff, was it served on you in a timely manner, tc?

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
