Refused refund or replacement

Hello, i recently bought a tshirt online using my credit card, i receieved the t shirt and it was too small. I sent it back same day 1 hour later.

Today they have said they are refusing to replace or refund it as i have wore it and ironed it. And caused damage. Which is a lie.

They will only send me back the small t shirt.

Where do i stand??

    They are saying i ironed the top caused damage to it and then sent it back. The t shirt is polyster and i wouldnt have put it under an iron.

    This is a tricky one I think similar to returns I've read about on eBay that a different item was sent back and the seller losing out because was unable to prove a substitute item was returned.

    Have you searched online for this seller or the website and found similar buying then returning experiences?

    Paying by credit card (not prepaid) does give additional purchase protection, but only if the items cost more than £100 and less than £30,000 because it makes the credit card company jointly liable with the shop or seller provider if something is faulty, not as described – or simply fails to arrive. Under £100 (assume your TShirt was) even if you do a chargeback and company disputes and wins, your refund via chargeback will fail.

    As you've purchased online and it's less than the 14day 'cooling off' period and was NOT as described (too small) may be worth going this route. Ring back and mentioned the Consumer Contracts Regulations 2014 rules more info here or read up on your the Consumer Rights on this forum post found here

    As said, they can refuse if can proven worn, damaged and ironed prior to returning. Onus is on you to prove it wasnt.

    Nothing to say it wasn't as described though, it could be that their medium is a smaller medium than another retailer.

    Plenty of times I've ordered shoes that vary by manufacturer, does not mean that ones that are too small are not as described.

    I can't post a link , not sure if anyone else can but for example..

    Their first 5* review was by DAKOTA collective .
    Guess who Dakota collective also work for..( " digital marketing executive")


    Their next (6 months ago ) Matt Mavir gave them 5 stars.
    Guess who Matt Mavir is?

    Following that Jordan DAKOTA Nixon gave them a lovely 5 stars.
    Obviously you can guess she owns DAKOTA Collective.


    After a very bad review a few hours ago, Scott Mcalpine gave them five stars ...

    Guess who Scott Mcalpine is?( As well as being Jordan's DAKOTA Nixon's boyfriend)


    And it continues..
    Reece Prested gives a lovely review , strangely by coincidence he also hails from Sunderland and is photographed elsewhere
    With most of the positive reviewers plus the owner.( I've got the screenshot)


    Despite all the glowing reviews on google you can't hide the bad reviews all saying this company won't give refunds.

    It's also very telling how they reply to the reviews in an almost mocking, arrogant way ( the " we're 23 and know it all" way)
    Numerous other reviews report being called liars.

    Avoid this company
