Ukpc pcn - emigration

Hi all,

I have read through the Newbies FAQ (superb work btw), but feel my case might be slightly different and would like to seek advice.

My PCN issue date was mid-October, and have received an NTK in the post. The slight twist is that I am emigrating in early-mid January. I read on another forum post that the UKPC won't take known foreign-based drivers to court, so wasn't sure if this would be applicable, especially if I essentially wait or if this case continues until after I leave.

Of course, it's not great leaving this hanging, especially that after I emigrate, the keeper will be a fellow family member, and that they also live at the same address.

So, does the fact that I am emigrating make any difference here, or should I still copy and paste the 'one size fits all' template and lodge an appeal? Or is even making the driver known at the point or after I have left a possible option?

    you can play it by the book with the template , or

    IF YOU ARE SURE YOU ARE EMIGRATING

    admit to being the driver , say sorry , send flowers , dont forget xmas card

    THEN

    send them a nice postcard in mid january (nice pic on front) from your new home town , stating that they should use your new address if they wish to communicate with you

    get this away from your family , just you , you only

    And wow... I really wasn't expecting that response - was kinda expecting somebody to say I'm being totally dumb and just follow the template...

    Btw, I am *100% CERTAIN* that I am emigrating too - visa already in my passport, passport in hand. Flight booked for mid-January.

    Was beginning to think this PCN was a case of bad timing, but it might be totally the opposite! :O

    So you legit suggest to just not respond until after I emigrate (does it really matter when?), telling them it was me who did this and then tell them my new address from over there? Would they still not try and get my family into this in any way?

  • NO you reply now , and accept any paperwork to your present address

    not that they can (in the time) you are not going to let them start a court case , timing would be wrong , they need several mths

    HOWEVER they must serve papers on last KNOWN address , which will be on your postcard , and by email if needed in several mths time

    they cannot serve papers to you in a forign country (unless its wales)

    so await other comments , but I say appeal now , saying nothing about emigration

    ince you name yourself , they CANNOT go after anyone else

    Coupon-mad, I've just found that Germany thread, and it's almost a spitting image of my situation! Mainly that... I'm not moving to Germany! :)

    I'm emigrating within 40-50 days as from today. The letter says I have 28 days to appeal and that appeal will be looked into within 35 days.

    Following that Germany forum, I will: a) appeal online close to the 28 day deadline, and b) don't need to follow the template and just state that I am the driver and to follow this up to my new address (which most importantly, is known) as my new point of contact.

    Similarly, to the guy moving to Germany - I can really do without any further hassle or time spent on this, so are there any other further actions I'm missing here, or anything else that I should be doing?

    Also, do these cases 'expire' over a certain amount of time? I read something about 6 years(?), just in the off chance I might emigrate back to the UK permanently, and if it might affect in any way within that time.

    I wouldn't use the template. I would appeal along the lines of "I is a rubbish parker so should be let off. My mate down the pub says you have to give me a POPLA code cuz there is a 2 hour grace period anyway.

    Plus I think I didn't do it. Dunno why but I couldn't have done."

    Anything to get them grinning thinking they have an easy target.

    If you come back to the UK in say, 4 years time, a PPC has no way of knowing you've come back and would not be looking for you.

    I once did that as a way of getting a POPLA code for someone when the 28 days had long since passed. It worked. The PPC could not issue a POPLA code fast enough as they thought they had hooked a victim who would lose.

  • Hi all,

    Update on this - I have since emigrated from the UK. I have received my POPLA code in the post to my old UK address, even though whilst appealing online, I did importantly stated that I was driver and my new address and I should be contacted there, to ensure my family doesn't get unfairly caught up in this matter.

    A family member who still currently lives at my old address has sent UKPC a letter in the post that I have emigrated and they have already been told my new address in my appeal, and that no other correspondences to my old address will be responded to by them.

    Do I still need to appeal to POPLA within the 28 day window or just leave it now? My appeal to POPLA doesn't fit in the standard categories online for appeal, so was wondering if this is even necessary or if it still needs to be done anyway... and to what success would this be?

    I wouldn't bother in your case, partly due to the fact you did receive a NTK and partly due to you having emigrated.
