Ukcps parking fine

Hi all hope you can help! My nana recieved a parking fine from UKCPS for parking in a disabled space without her badge on show - which she ignored she then recieved another letter which she replied to asking for evidence that she had parked in a space without showing her badge. They responded with a photo which didn't show whether she had or hadn't had it on display. However she has then recieved a letter from County Court Bulk Centre stating the charge has gone up to £185.00. My nana is 100% sure she had her disabled badge on display. Since all communications from them my nana has since had a stroke and I'm dealing with all her correspondence on her behalf. HELP WHAT SHOHLD I DO?

her BB is not valid on private land, so I believe she is confused about where and how to use it, terll her to read the vlue booklet that came with it
the EA2010 may cover her on private land, but for now she must defend the court claim issued by Northampton CCBC

Definitely read the NEWBIES thread and create Government Gateway account in her name and acknowledge the claim in her name (NOT YOURS, you cannot do this 'on behalf of' the Defendant).
But you can can be the one to do the work! Once acknowledged, the defence comes next and there are examples in the NEWBIES thread.
She will win at a hearing, I would bet. This is disability discrimination, exacerbated by unwarranted demands and harassment.
I hope in her appeal, she told them she did have a Blue Badge (and even better, sent them a copy early on, so they KNEW she is disabled & had a right to park there under the Equality Act 2010)?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

In that case that is what she tells the judge.
As CM says, the PPC would struggle if this went to court. They would have difficult in proving that your grandmother's actions in allegedly breaching the alleged contract so damaged them that they need £185 to put matters right.
It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
With an Issue Date of 24th October, The Acknowledgement of Service should've been done by Monday 12th November.Issue date is 24th October.
Was the AoS done in that timescale?
If not, the Claimant has been able to seek a Judgment by Default against the Defendant since that date.
Please check on MCOL to see if that Judgment has been made.
If the AoS was done in that time, then the Defence was due to be filed by 4pm on Monday 26th November - yesterday.
If the AoS was done in time it would be prudent to get cracking on a Defence to get that filed as soon as possible.
Ideally, the Defence will be filed before morning.
When you are happy with the content, the Defence should be filed via email as described here:
1) Print your Defence.
2) The Defendant must sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the words Urgent and Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.0 -
