Hi all!!

I have read a few threads and success stories but I don't think there is any (not that I found anyway) that match my circumstances - If I am wrong then apologies for re-posting!

The Lessee was parked in a Morrison's car park in Leeds City Center and received a Parking Charge Notice through the post to a company address, the PCN contains ANPR pictures of the car. The PCN was issued on 22nd of November. The charge amount is £85, or £50 if paid within 14 days.

The time in car park it says is 15 hours and 40 minutes (and the maximum stay was 2 hours). The lessee called into town to visit other attractions (i.e. not Morrison's) and 2 hours parking was paid for at 7.22PM. The lessee then wanted to stay in town for a bit longer and returned to the car at 9:10PM (ish but it was definitely after 9PM and before 9.22PM when the original ticket expired) to put some additional time on the ticket (the lessee did not see the maximum 2 hours sign on first entry). When putting money into the pay and display machine the time would not change and that is when it was noticed that the charges were only applicable up to 9PM, hence no ticket was purchased. Prior to leaving the car again the lessee checked the signs but could not find anything that indicated when the car park actually closed and with out such the lessee deemed that the car park remained open but only charged until 9PM (like most pay and display areas).

Upon return around 9.45PM the car park had a large metal roller shutter-type shutter that was down and access to the vehicle could not be gained. The lessee then ended up getting a taxi home and returned for the car aiming for 11am when Morrison's opened.

For the record, the pictures they took only show the number plate and lights, everything else is black. They are apparently pictures of the car entering and exiting the car park which the times seem to add up to my logic above. This is also a company car so I would prefer not to get any further demand letters as work will see them before I do.

The lessee has not yet appealed or taken any action. I was wondering if the lessee has any argument to cancel the PCN or if the lessee should just slap himself on the wrist and pay the discounted amount?

    as its a company car, pay particular attention to that section and the advice given by member edna basher


    name the car park in question too


    the pictures are ANPR pictures, so are to highlight the numberplate, they are not passport quality photos

    I was wondering if I have any argument to cancel the PCN
    You need to read the threads on the forum...
    or if I should just slap myself on the wrist and pay the discounted amount?
    ...and tell us where ANYONE ever says that is a valid option re this scam industry?

  • @Umkomaas 100% the previous one wasn't me, I saw on other threads to not have your username relate to me in anyway and that was funny enough thew first thing I thought of.

    And in response to the others comments, I have read the threads and some of the "wins" but I don't see any where the keeper was unable to leave the car park due to a shutter (or any other form of barrier) nor any that relate to a car park that didn't clearly display such information regarding the shutter coming down.

    I would have thought that seeing as it was after 9pm when I returned and the shutter was not down, it would be reasonable to assume that the car park simply stopped charging after 9pm but remained open.

    look up "frustration of contract" , if your vehicle is held hostage then I doubt they can claim for the overstay whilst it was imprisoned
