  • you’re right, I muddled some words up here about the defendant paying for a ticket, this was a free for 20mins car park, no ticket was purchased! My bad!
  • Just a quick update to say I sent off my defence on the 24th following the instructions on KeithP’s post. I will wait a few more days to see if my MCOL status changes to defended before chasing them up! Thanks again for the advice.

    Another small update, the defence wasn't marked as received this morning so I called CCBC, the helpful lady on the phone told me to re-send with URGENT in the title and it will be done, perhaps they were short staffed on the 27th!

    I did manage to drop a ball and attach the unsigned copy of my defence to the email, but quickly emailed back with the correct version, fingers crossed they will use the edited version!

    UPDATE 2

    MCOL have now updated the system to say 'Your defence was received on 28/12/2018'. I do have proof this was sent in on the 24th with a timestamped sent email and auto response return email. Should I chase them up to rectify this incorrect date? Or just keep proof that I did in fact file my defence in time and the incorrect date is due to administration error not late filing?
  • Just a quick update.

    I have recieved the directions questionnaire N181 which I will fill in as per bargepoles advice on the newbies thread.

    I also have received the SAR from CEL and one thing is particularly interesting to me! On the photographs they have supplied of the vehicle in question entering the car park, the registration plate is clearly not visible. I suspect this is why I wasn’t sent photo proof in the first place! Maybe something for the WS?

    Any advices on what will come next will be helpful! Thanks again all!

    Not really - if it is obviously the same vehicle, and you do not deny it is your vehicle, it doesnt really help you does it?

    Court isnt abotu "gotchas" .

    The advice is: read post 2, reread post 2, then read it again.
    Obviously you shoudl read other CEL and general cases, so you know the process.

    LIterally nothing youre doing is unique or spoecial, its been done hundreds of times, and every question already answered.

    Correct, and I’m not looking to find a gotcha but with that being said, I strongly believe they have forged something here. They have taken a APR snapshot of the registration leaving, and stuck a time stamp on it with the entering time. I didn’t think such a thing would fly considering -to me at least- this manipulation of ‘evidence’ can’t be legal. (Also I’m not getting hung up on this, I believe my case is strong enough to win and am happy to leave this out, but I’m pretty sure this has been manipulated)

  • Morning all, just a quick update.

    I just got home from working away for a week and I finally have a letter with a court date, 25th of April! Honestly wasn’t expecting this as CEL didn’t send me a copy of their DQ so I was half expecting them to drop it, not to worry!

    I will work on a witness statement and post a draft, thanks again.
  • Big big update, very happy to say I have received a letter of discontinuance today!

    Huge thanks again to everyone who’s helped me and others in my position, finally I can say..... ‘Another one bites the dust!’
