MBNA credit card fraud

    Can you get proof of your whereabouts when theses transactions were made? Anything from work or any other charges in statements that show you were not in the same area?

    Banks can not hold you liable even if the charge has been made via Chip & Pin, they need proof it was you.

    Have you had any new cards sent out for this account, renewal that could've coincided with the change of account? MNBA allow pin numbers to be viewed online, can anyone get access to your online accounts? Did you have any issues logging back into your online accounts when you downloaded the app again?

    Your best bet is to get as much evidence as possible to prove you were not in the same area and that it would be impossible for you to travel to the cashpoint in question, then make a formal complaint, they will most likely reject it then take it to the FoS.

  • This is correct, I had two virgin credit cards and when MBNA closed the account for all customers they sent out a Horizon card. I destroyed one and left the other in a bedroom drawer, no pin was written down anywhere.
    As my card and pin were used I guess I am liable but my issue is the way the whole thing was handled. I tried getting cctv from one atm but was refused as is has to be police requesting and by this point it was reaching the 28 day deadline when cctv is written over again

    You seem rather relaxed about this, can you prove you were elsewhere in the UK when the charges happened? If you can then it's not possible for you to be in two places at once.

    Although MNBA and the FoS may not view it like this, as the FoS go on "fair and reasonable" my belief is a court would view this differently as legislation does not say a Chip & Pin is a good enough reason to hold someone liable for fraud.

    You seem fixated on the CCTV, likelihood is if someone was using your card they would not be showing their face. Is there more to this story then what you're letting on?
