The correct route to refunds if an originator (BMW FS) is taking the incorrect amount from your bank account is your bank. Your bank is responsible for this and will fill out an indemnity form to the originator who will refund the bank. Never risk your credit history to sort out an error. Go to your bank and demand the refund, they might try and put you off, but this is part of the Direct Debit Guarantee.0

Finance companies don't really have a choice ... S75 is a legal right for relevant claims. If you have a claim against the retailer you have an equal claim against the credit provider. The consumer can pursue either or both parties in respect of the claim, so if the retailer is not responding then the consumer can pursue the credit provider separately.0

They arent they are over charging me - as per the agreement i signed is for one amount, they are taking more0

Car is HPId yes, also had a 120 point inspection which it cant have had because of the issues.
The car is rusting right now, all the sill has been bodged back on, filled with filler and not correctly painted.
I wouldnt be able to see that as a buyer as its under the car. They should have seen that if they checked it and told me.0 -
If the ombudsmen said you've to return the car then take the car back to the dealer with ombudsmen statement and leave it there. Give them both keys and sign the V5 over to them. Write to the finance company that the car has been returned as per ombudsmen and then take it back to the ombudsmen if they don't respond.
Contact your bank about the incorrect payments. You should be covered by the direct debit guarantee which allows the bank to refund any incorrect charges.0 -
The obudsman works in weird way - the person handling my claim has said to BMW to take car back, and remove from my credit history. As the finance company ignored her, she has now passed it onto a ombudsman, even though it was the obudsman i went though.
Now i am awaiting that result, which im told could be months.0
