Casework

ESA are preparing my casework papers and will sent to me within month. Do they also send them to tribunal and my rep? Or do I need to copy them and send myself?

    DWP send everything to HMCTS, then you and your rep will each have the "bundle"



    As you have a rep then you don't need to do anything because they do it all for you, which is the whole points of having the rep in the first place.

    Your rep and the TS will get their own copy.

    As all three would receive a copy, how many days would it take (it said 28 days) on the text message?

    I understand there will a submission paper to send within two weeks, who gets it?

    I'm asking these questions, as the organisation I am using will be closed during holidays (it might be impossible to meet DWP deadline).

    The submission that you need to send doesn't need to be done within 2 weeks. It needs to be done before the hearing takes place.


    There's no DWP deadline for you to meet because it's with the Tribunal now not DWP.


    The rep you have should deal with all this for you and you shouldn't be doing any of this. All you need to do is be there on the day of the hearing to answer any questions they have.

    It is the DWP who have a 28 day deadline to make a submission to HMCTS so that it can be included in the bundle. You and or your rep can make a submission at any time before the hearing after you have had time to review the bundle.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

    It says 28 days for DWP to get the papers to me, rep and TS. My question was because of holidays coming up.

    I muddled my earlier response. It’s 28 days for the DWP to prepare their submission and issue it with the bundle which is sent to HMCTS, you and your rep.

    Even if their is a slight delay due to Christmas it is not a big deal as it will be many months before the tribunal hearing.
