    wow! Never obviously happened to you then as pretty scary and totally messes with your emotions- thus my asking for advice on here.
    There are two aspects here.

    The first is the emotional aspect. Poor you. Hug.

    The second is the legal liability question. No, BMW are not liable. Your car insurance may or may not cover the contents you lost - if it doesn't, then your home insurance may or may not.
  • This is exactly the sort of thing Social Media is actually good for. Get some photos of the car and purchase documents (minus personal details) and start causing a fuss. They might change their tune when they start getting bad press. The very fact there was a recall on other models means they should be taking this very seriously. A car thats just over 1 year old should be have this happen.

    This is great advice. Don't worry about the family, get back to the burning car to retrieve your phone. A phone so you can take pictures is far more important than personal safety, or the safety of others.

    Where in the OP or anyone elses wording is there even a hint that that was what anyone suggested ?

    The fire happened in August, im guessing the family have already decided to get out of the car.

    OP will already have taken pictures, I am just advising them one course of action. Which is more than you have offered.

    Hello,

    Sad to hear this happen.

    My 525D went up in flames on Tuesday and i have been dealing with my insurance company who have towed what is left of it to a scrap yard and BMW have advised (after a massive fuss from myself) to investigate the car at the scrap yard.

    They have advised me that if they are not able to see the defect they will not accept liability for it leaving me a potential shortfall of £8,000 on my PCP. I have argued that the car is so burnt they are not able to have a detailed look but they have said if they cant then they wont admit liability.

    The most annoying part of it is that they are dismissing the current fire scandal they have as 'not their responsibility'. I do work for a major newspaper company and will bring this to attention through them but i am not speaking anything now as i want to see what it comes down to.

    I also want to start a facebook page to bring attention to all of this!

    I am not sure how to post a photo here but let me know if you want to see the damage done to my car.

    Good on you if you can get this into the press. Im sure the more savvy on here can explain how to post photos.

    Whats the point of a picture of a burnt car ?

    We know what they look like. And if anyone doesn't, they can look online.

    It wont show the cause or whose fault it was and doesn't further your cause.
