Court Claim PPS (BW Legal) - Mediation?

Have largely used same defence as DevonChap for a PPS fine in a Devon carpark - we too didn't understand the signage and understood free after 8pm. Have followed advice from the forum and responded online to the court summons. Have now received a letter from BW Legal offering a one hour mediation phone call - I see someone mentions checking out Bargepole's updated summary and advice elsewhere to not bother with the mediation but unsure what to do e.g. does it look bad to not participate in the mediation and therefore count against you? A link to any threads (I've searched and haven't found anything other than mentions here and there) would be much appreciated.

    No. Simple answer - there is NOTHING to Mediate here, you owe nothing and the PCN is of the sort that MPs have described as an 'outrageous scam'.

    You have no common position to Mediate on and will be bullied in the phone call to settle. All pointless and makes you feel bad/like you have no case.

    The NEWBIES thread does show you some people's Mediation experiences and WHY NOT TO DO IT!

    Did you read all the wins on the forum today?

    One posted about by bargepole about a case today at Guildford court, another by another UKCPM defendant at Liverpool, and I think a ParkingEye one as well that I was told about but haven't read yet.

    Mediation is a BIG NO NO

    WHY ... because you will be talking to someone who has no clue about the parking scam and their job is to save court time.
    BWLegal knows this but if they were that sure of the case, they would appear in court, albiet one of their "rent a mouth" bods would attend.

  • I have today received my date for court and it has been suggested that the case is suitable for mediation. I think that the courts are getting a bogged down as my case is not for another three months+.

    How can anyone mediate with these people? They are totally unprofessional. They have passed around information to third parties, harassed and hassled. They are vile and should not even be breathing the same air as ordinary people. Needless to say there will be no mediating on my part. I would rather put my hand in a snake pit.

    Understand that these people are scattered around the UK, they are professional types but not professional enough to begin to understand the parking scam.

    You know it is said that traffic wardens are frustrated wannabee police officers but do not make the grade ?

    What's the difference between a mediator and a real judge ???

    Mediation is offered as standard in a small claim. The judge won't know or care if you went to mediation or not. It's confidential so you may have been and not resolved matters or you may not have been.

    All the judge will know is that you are there in front of them. That way no blame or criticism can be levelled at either side going into a hearing.
