    Yeah, I agree with that. If you signed a contract saying you'd pay me a tenner every time the sun rises, it wouldn't matter that I had nothing to do with the sun rising, or that I could do nothing to stop it, and obviously the sun would rise regardless of whether you actually paid me - but you'd still owe me.

    I can see the arguement.


    But I'd love to be in court on the day the landlord sued the tenant for the renewal fee where a SPT arose.

    I would have thought no, Statute Law supersedes Contract Law so although the tenancy agreement was signed with this clause in place and a fixed term automatically goes periodic as laid out in law at the end of the term then I would have thought this fee is not enforceable.

    if it says annual, then it will be interpreted as annual

    so if you are happy with a £25 per year increase, i would not object to this as you may find they spot the mistake and ask for £25 per month increase
    But it says a minimum of £25. The OP would probably not mind an extra £25pa but the actual sum is unspecified.


    Is the agent's thinking that by specifying in advance that the rent will rise annually they can impose charges on the T and LL for new annual contracts?

    it must be a yearly rental increase. Not a chance they would get someone in on a monthly rental increase as by the end of year one your rent could have doubled.
