Can the vendor remove fitted cupboards in the kitchen?

    I dont think this is a fair comment. The agent has marketed the property with a kitchen. The contract has turned up saying the kitchen is excluded. That needs fixing - and as they haven't exchanged yet, they can go back to the agent and the seller and demand that they get the kitchen as fitted or a price drop.

    OP - you need to get the EA or your solicitor to clarify that answer, as it is really odd. Get the EA to do it by phone first as it'll be quicker, then get your solicitor to confirm the answer in writing through the buyer's solicitor.

    It's legal in the sense that the Fixtures and Fittings form is part of the contract, and tells you exactly what is included and excluded. If, on completion, they haven't included something they said they would then you can take action against them.

    It's annoying when you get a shock with the Fixtures and Fittings form. With our last house, we found out several pairs of curtains were being taken. We stupidly hadn't said we wanted them when we offered, or we'd have known earlier that the vendor wanted to remove them.

    Taking the kitchen would be bizarre! Would it also leave the kitchen with no oven and hob? If so, your mortgage company might not be happy as I seem to remember most standard mortgages want the house to have a working kitchen and bathroom (might have made that up).

    You need to find out exactly what the vendor's plans are, exactly what they'll leave, and exactly what state the room will be left in!

    If the kitchen is being taken I'd ask for a significant reduction. Depending on the size of the room, a new kitchen will cost you £5-15k.

    Agree with the others though that this is most likely to be a mistake on the form, in which case your solicitor can ask for a fresh copy to be issued.

    On further reflection if this isn't a mistake (please do let us know OP) I'd be almost certain to walk, who knows what else such strange people might do, or even if they will take it anyway out of spite* or something else. I would not accept a lower price because of the hassle let alone the cost.
    Hopefully it is just a mistake or refers to a single freestanding cupboard.

    If it truly is the case, check that form very carefully as I'd expect them to be taking everything from carpets, chrome light/plug sockets, oven and fitted appliances, to curtain poles...

    I agree with you all, it seems very odd indeed. There was another freestanding cupboard in the kitchen, just opposite the fitted cupboards, maybe the seller was thinking about that one. apart from this, everything else remains, eg oven, hob, light/plug...

    They just need a fitted kitchen sink/tap.

    Anything else isn't that important... so long as you have a sink and a tap.

    Are the sellers from another country?

    This sort of thing is very common in, for example, Italy where the sellers take everything with them and get whateveritis fitted in their next property, and by everything that means when you buy and move in you basically get four walls, a roof and the external doors - some of them even take the sockets and internal doors with them as well as the kitchen, and you either have your own kitchen and other bits to put in or go out and buy them ready to put in.

    Could it be one of those sort of sellers?

    When we bought our current home the vendor told us the fitted lights in the through lounge wouldn't be included. He would have them replaced with single lights.

    At least they were up front about it.

    If I got he paperwork through and it also said not including the kitchen units I would think ok...... Time to review offer.

    Cost of new kitchen +50% for hassle. Would also check everything else from door handles, lightbulbs, curtains, tracks/poles, floor coverings.

    I'd be reducing my offer and be prepared to walk
