    There are several reasons why we do this, probably all different.

    But we all share a hatred of the scam operated by PPCs, and most recall the injustice of the POFA 2012 giving the scammers the unwarranted and undeserved power of 'keeper liability' (and the well-documented BPA lies/inaccuracy about the court figures to steer Schedule 4 through), and the injustice of the Supreme Court's frankly dreadful anti-consumer and wrong decision in ParkingEye v Beavis.

    Each time, we are stronger. And so are you, because we are with you every step of the way.

    And with court defence wins still consistently around the 99% mark we must be doing something right and we even see several local courts who now 'get' the PPC scam and are graveyards for PPCs.

    Re your defence, it looks good, and I see no reason to add to it, except I wouldn't give your wife's name (no need, too much information):
    however the driver was the defendant's wife XXXXXXX.

    What can I say but thank you.

    I feel reassured about the defence. Just one thing suddenly sprang to mind. I am sure I read somewhere in a post that the defendant needs to state why their case is different to the Beavis case. Is that necessary here?

    You can cover it later, in a skeleton argument (like a crib sheet for you, for the hearing). It is clear that this defence is about signage being inadequate, so it stands apart from Beavis straight away and that doesn't have to be said in so many words, yet.

  • Update: I haven't submitted my defence yet.

    However, I had emailed PE'e enforcement asking if they would settle following RedX's suggestion. This was before I did the AOS. They have now replied back and want to settle it at £120.

    Should I just ignore and go ahead with the defence.

    so that is their opening offer , so personally, I would issue a counter offer, starting much lower , like an auction

    I dont say this lightly, normally I would be saying let them go to court , but in this case I believe they have a good case and MRS hurtbuyer doesnt so therefore I believe the keeper is in a poor position
