Homeless and need force of sale help

Hi all,
I want to know is there any help on solicitors or any solicitors who will assist me to take my ex to court for force of sale of property. I and our 6 year daughter will not have a fixed address from 16th December has i have to given notice on the property i rented since the split over a year ago.
All i want is to cut the financial tied between me and her father. I have being paying for repairs for the property while i haven't being there. I sent a letter to his solicitors saying has he view his options has they sent me a letter in February asking for us to allow him to view his options. Now he has had 9 months to view his options and i haven't heard anything back in the 9 months but yesterday i had a response from his solicitors saying they are no longer dealing with the case.
I cant afford the £1000+vat fee my solicitor wants to apply to the courts i can borrow £300 court fees but the solicitor ones are the worst ones.
So i am thinking of just applying to the courts myself i have alot of time on my hands now with only doing part time work and i want this to get sorted. I have offer before i quit my full time job to buy him out but he kept on saying No, so i asked him to buy me out and he still says No. So all what is left is to sell the property has i think this is holding me back for getting housing of the local council too has i being refused for housing so far.
Any help much appreciated on applying to the courts for force of sale.

given your standard of written English do not try to deal with courts direct yourself
you have been told how much it will cost to force the sale, focus on finding the money to afford that
as you kept the child why have you not got a financial settlement that provides for the child as part of your divorce?0 -

It sounds as if there's a lot more to this than is apparent from your post.0 -
If your name is still on the mortgage then you can still move back in.
It might not be ideal, but it is still your home and might get your ex to move quicker if he has you living there.
Quite why you’ve been paying for repairs I do not know as I don’t think I would have been as well as renting elsewhere.
In reality he should have moved out seen as you have the kid:T:T :beer: :beer::beer::beer: to the lil one:beer::beer::beer:

I believe it will take much longer than this to force the sale of the property - in fact, even if you and the ex agreed today to sell as fast as possible I don't think you'd manage it. So I'd focus on sorting out accomodation first.
I'm not actually clear from what I've quoted what your situation is. Is it:
1. You have given notice to your landlord
2. Your landlord has sent you a notice
If 1 - why?
If 2 - if you can post more details about the notice people here will be able to advise on your options.0 -
So you are making yourself intentionally homeless, and are still wondering why the council aren't helping you at the moment?
Also why are you only working part time. If you are in financial difficulty, keeping or looking for a full time role would have been the sensible solution to these issues0 -
hbrennan18 - There is no way the council will house you if you own a property (why should they?).
Is there something you are not telling us?
If it's not safe for you to return then it would be better if you gave details as you'd get better advice.0 -
Just to give you an idea...it took nearly 4 years for me to force a sale with my ex.
He did not reply to a single letter as he refused to deal with a solicitor so every letter had to be served. Would not cooperate with estate agents and eventually he ignored the bailiffs who had to do 3 visits to get him out. Along with the 2 court visits he did not attend.
It is a long process I am sorry to say..the judge did award for all legal costs to be paid from his share though as he was not impressed by his pig headedness:D
I was dealing with 4 years of chemotherapy with our son whilst this was going on... didn't have the chance to stay in the house either as he changed the locks whilst I had been living in the hospital for 4 months:(

I think the first thing you need to do is focus on your immediate housing situation.
Contact the council or a housing charity to get free help with your own housing, employment and benefit situation. You want to be careful to make sure you are not viewed as intentionally homeless.
Trying to force a sale of the property would be a longer term project I'm afraid. As others have pointed out, forced sales take a long time.0
