Parking CCJ

Hi all.

I have followed you’re help and guidelines on a parking ccj.

I have competed the AOS and am going not guilty.

I received a letter from Northampton county court acknowledging this.

I have also received a letter form Gladstones solicitors which says:

“We act for the claimant and have notified the court of our clients intention to proceed with the claim.

Please find enclosed a copy of our clients completed questionnaire, which willl be filed with the court upon their request. You will note we intend to request a special direction that the case be dealt with on the papers and without the need for an oral hearing.

This request is sought simply because the matter is in our clients opinion relatively straight forward and the costs incurred by both parties for attending an oral hearing would be disproportionatell. We trust you agree.

You wil note our client has elected not to mediate. It’s decision is not meant to be in any way obstructive and is based purely on experience, as mediation has rarely proven beneficial in these types of cases. Not withstanding this our client would be happy to listen to any genuine payment proposals that you wish to put forward.”

This is the letter I received along with an attached directions questionnaire (small claims track).

What is the next step now? Shall I ignore this, film it in?

I’m stuck and don’t know wha to do next. Please, any help would be much appreciated.

    This needs to be on the parking tickets board at the top of the motoring section.

    The DQ needs to be filled in. You do not ignore papers from court. In the section that tells Newbies to read it first there is a pictorial walk through of how to complete the paperwork.

    It's not a CCJ. Not yet. CCJ = County Court Judgement.

    It's a claim. The CCJ may come later, if the claim is found against you and you don't pay. The last think you want to do is ignore it - it will NOT go away.
  • Its not a case of guilty or not guilty, a CCJ is not a criminal conviction. If you think you have grounds to get the case struck out, you must enter a defence (based on law). If you do not reply, Northampton will award the claimant full settlement plus costs in default, and you will have a credit wrecking marker on you. Though, seeing as they're not willing to mediate must mean they are pretty confident of winning.
