Online purchase - wrong size clothes sent, no reply from retailer

Hi everyone,

I bought my girlfriend some clothes online as a gift, and the retailer sent one item in an incorrect, smaller size. It is very obviously too small, and also has a very different size printed on the label.

I placed the order on 3rd Nov, the order shipped the 7th and it was delivered the 9th.
I emailed to let the company know about the size issue on the 13th as it was opened over the weekend. Then had no reply so contacted them via their online message service (form on their website) a few days later. Still no reply, I have emailed them again on the 18th November. I haven't had a reply whatsoever, and was wondering what I should do in this situation.

Any advice would be appreciated on how I am meant to move forward. All i want is a replacement with the item in the correct size as the one I ordered.

  • Where do you think the retailer is based? UK or elsewhere?
  • I think it might be in the UK, and on their website under returns it says:
'The law says: With the implementation of the EU Consumer rights directive, consumers in the UK now have 14 days for unwanted goods to exercise their right to withdraw from a distance contract or off premises contract (including internet sales) without the need to justify and at no further cost other than supplementary costs.'

Which makes me think they are in the EU at least.

Am I able to post the name of the company on here?

    Yes

Have you called them , if they are UK based I would expect a phone number and an address to be under contact details
  • Do you mean the dress size on the label is not the size you ordered, or do you mean it's "wrongly" labelled with the size ordered?
  • Hi,

    So the website is https://curvaceousbeauties.com.
I have looked more info up and their facebook site has a number so I will try and ring them tomorrow.

The size on the label is several sizes smaller than the size ordered.
  • I have tried phoning the retailer several times, and I'm unable to get an answer.
Any further advice? As I am not sure what to do now!

How did you pay? If paypal, start a dispute, if credit card look up doing a s75 and if a debit card look up doing a chargeback. If some other payment method they might have a similar scheme.

S75 only applies if the purchase price of the item is £100+, otherwise a credit card reverts to the Chargeback route.
  • I used a debit card.
I will look in to the chargeback scheme, is this straightforward?

Disconcertingly, i have visited the website to go to the checkout process to ensure the Lock icon was next to the URL, as I had started worrying that it might be a bit dodgy given the lack of response.

When you try to place a purchase through the site it says:
    Oops, something went wrong.

    What happened?
Checkout System disabled: Checkout is disabled.

I'm guessing they're either having technical issues or might be shutting down?

The only other thing, is that all the other items in the order are correct, just thought I should add that so that I am giving a balanced picture.

Might not be dodgy, but comes across as a one man band either dropshipping or working from his bedroom. The website is seriously lacking in details, the FAQ doesn't work, there's no contact phone or address etc. I'd be wary ordering from somewhere like that again.
