One thing I realised in court was that the legal arguments didn't seem to mean as much, the judge seemed very dismissive of them on both sides. What it seemed to come down to was whether it was fair.We know that there is a very 'high bar' for obtaining costs for 'unreasonable behaviour' and it's not often we see costs being awarded for much more than loss of earnings/annual leave, travel costs to the hearing and parking charges on the day.
Yes. I was a bit stumped when she asked me why it was 'unreasonable'. Perhaps if I had been able to state my case for this more clearly, but oh well!0 -

I claimed half a day of work, which was about £65. No travel fees, as I used my normal travel card.
4 hours litigant in person fees plus £10 for stationery was declined, as per the above post.0 -

Now avoid PPC scams like the plague, read signs carefully like we do (we never get PCNs) and join the group of drivers who are being encouraged as a matter of principle against data harvesting by scammers, to cover their numberplates when leaving any site with a PPC ANPR camera.
On a daily basis check which way the exit camera is pointed and always refuse to let them see your VRN by covering the appropriate plate with a sock or bag, or gaffer tape, until out and on street.
If everyone did that, on principle, whether they overstay or not and whether they are disabled/authorised or not, then ANPR scams would be dead in the water.
I realise your case was not ANPR this time, but I am just pointing the way forward to avoid any such scams in future, and to read signs and vote with your feet/wheels and just no go to places if a PPC scammer lurks in the shadows.
Certainly never move into a flat with a PPC scammer/permit scheme. Completely unnecessary at any residential site, even near shops/station/stadium, etc.

Gallstones didn't turn up. The judge didn't care much for the notice to keeper argument, but agreed that the bays were not clearly marked. Case dismissed.
Note for future cases, the Judge objected to the costs being down to 'unreasonable' behaviour, and so only agreed to pay my lost wages, not my expenses.
