Hi,
Perhaps we're starting to see PPCs giving up at the very first hurdle now in train station 'byelaws' PCN appeals. I received a 'Notice to Owner' from Indigo recently and appealed with the standard blue template from newbies thread and received:

Thank you for your correspondence in relation to the above Penalty Notice.
Upon viewing the images from the day in question and having noted the
comments you have made, I can confirm that your appeal has been
accepted and the case concerned has been closed on this occasion.
However, please ensure that a valid ticket is purchased with your correct
vehicle registration to ensure that you do not receive any further notices
for the future.

I don't know. Since the DfT told PoPLA that motorist should be offered access to independent appeals it could go either way.

as posted elsewhere , they can decline , they can issue a POPLa code*
then they have the choice to pay it and fight of simply not bother , even if they win , they are snookered , as they only have 6 mths to start magistrate court action , however in the case of indigo , they have not got permission from TOC to start court action
* the bpa said it was clamping down on misuse of popla codes , if the company declined your appeal they should follow thru with a popla decision , not drop out beforehand0 -
The first POPLA Byelaws decision is going to be interesting. I bet it won't be left to one of the former nail technicians to deliver!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

but then what? if a person sits on request till correct day , then takes his time doing popla , easy b2-3 mths gone , as you state the best will be used to adjudicate , they will be busy , , at least 3-4 mths , then what , indigos contract forbids them to start court action
and lets see if the BPA uphold there thoughts that a popla code should be used and paid for0 -
I wonder if Indigo will now only take admitted drivers to POPLA (i.e. the victims who are not on forums) so they can show a better win rate than before, which the BPA can then use to paint a picture of liaising with the DFT and playing nicely, and ''look, these cases are being won at POPLA so these railway PCNs must be legit and people are paying them...we need to extend this scheme across the Country...''
There will be an ulterior motive here if this starts to become a pattern now. It will mean we will see this reply from Indigo to our appeals, but that behind the scenes they are upping their win rate of POPLA appeals by cherry picking them.

If indigo do that, they will lose the appeals. POPLA's latest guidance states (completely wrongly) that PPCs can only pursue the owner:

So I guess Indigo will apply to the DVLA for keeper details, claim (wrongly) that there is a rebuttable presumption the keeper is the owner, and try to up their success rate that way.
This is a gross mis-application of the law but it doesn't matter that much. It just means POPLA appeals will be as worthless as IAS ones. People in the know can still just sit tight until the 6 months is over.0 -
Surely, in many cases, he vehicle is owned by a finance company.You never know how far you can go until you go too far.0
