Advice needed!

Ive just received a letter before claim from Gladstones. I was issued with a PCN while visiting at the address. I was not the driver of the vehicle when ticket was PCN was issued. What should I do?

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future..
    You never know how far you can go until you go too far.
  • Theres alot to read in the newbie section. Could you point me to something specific pertaining to my incident.
    I was a visitor at my mums and my car had only been there a few minutes before the guy came with his camera and started taking pictures of my car. I was then sent a PCN from ES Parking enforcemt ltd stating they were writing to me as the registered keeper for not displaying a valid permit. It went on to say tharlt the driver was liable for the parking charge however I was not the driver at the time. I appealed to them saying I was not the driver however they rejected the appeal without really addressing the fact that i was not the driver at the time.I have now received an LBC from gladstones
    what is the likely chance theyll take me to court?
    and if they do, do I have a chance of winning?

    Yes, thre is a lot to read, but its there for a reason

    Literally youre told, in bold, not to look for exactly the same areas.

    COnstruct a robust response to the LBC. If the claimantn has failed to meet the requirements of POFA, then you as a non-driver Keeper have a compelte defence.

    If you're not willing to help yourself why should anyone else make the effort?

    jj1212 .... the point of this forum is to offer help and guidance and hence a lot of work has gone into the Newbies thread

    In general, it is expected that you form your own defence from the knowledge base of the Newbies thread

    Understand that the vast number of claims such as yours are simply copies of other claims made because the PPC's and their dodgy legals have little else to say

    Gladstones are known to be incompetent so we can offer further advice on the LBA.

    I'm sure you can scan the letter, removing all personal info, upload to a free hosting site like tinypic and then paste the link here as hxxp not http and someone will make it live.

    Yep - it took me a long time to put together, and to edit it regularly too, over the years. I make no apology for the amount of content.

    You know how to search it by using Control & F, so do that. You know you are looking for the post about court and pre-court stage so it is pretty obvious which bits to read (and what NOT to read) but Control & F will help you find 'Gladstones' sentences to narrow it down.
