Plevin Query

Hi, I wonder if anyone can help.
I just wanted to clarify a query I have around Plevin and PPI
My understanding is that if you were mis sold PPI on the grounds that you were ineligible when it was sold to you, say you were not working at the time, but further down the line you were working and made a successful claim, say for being ill.
Any upheld complaint would rightly have the money that they had paid out in a claim deducted, before paying you any remaining balance, if any.
Now say that you were not mis sold PPI and you made a Plevin claim that was upheld. So you were still paying PPI. Would they still deduct the amount of money they paid out in a previous claim, before paying any remaining balance if any ?
I query this as you are still paying PPI.

Plevin is only looked at after a complaint is rejected, you can't ask for just a review. Logically then, if you complain about ppi the policy will be cancelled, you can't have it and expect a refund

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Hi Nasqueron
Thanks for your reply.
There seems to be a misunderstanding.
I have already made complaints regarding all my mis sold PPI several years ago. They were all upheld as I was not working when they were sold to me as I was a homemaker. Even though later when I was working, I had made claims and benefited from a payout on the PPI on these cards when I became ill.
The amount I had claimed was deducted from my redress, and rightly so.
My query is around a PPI commission complaint (Plevin) that I haven’t put in yet.
I have one credit card (Barclaycard) that I haven’t made a PPI complaint on because it wasn’t mis sold.
I knowingly took the PPI out when I was working. I also made a successful claim on the PPI when I fell ill quite a number of years ago now.
It’s this card that I am going to make a PPI Commission (Plevin) complaint about.
Barclaycard advise on their website that you can put in a complaint just regarding PPI Commission (Plevin).
I just want to know, if the PPI commission complaint (Plevin) is upheld, will they deduct any money paid on a successful ill health claim made on the PPI, out of the redress (like they would do with a PPI complaint) ?
OR
as you have still paid PPI and not had it refunded, will you get paid the Plevin redress with no deductions ?
Btw, I no longer have these cards so don’t have to worry if they cancel the ppi.0 -
I queried this with the FOS.
The advised that the policy wouldn’t be cancelled if just making a plevin complaint.0 -
Hi
Thanks for your reply,
I don’t have the cards anymore for the ppi to be cancelled. It was already cancelled years ago when I cancelled the cards.
My query is will they deduct the money I received from making an ill health claim on the PPI from an upheld PPI Commission complaint (Plevin) or not ?0 -

If you have already complained and had the refund of the PPI (minus any deductions) then there is no further complaint needed. Plevin refunds are included if you have a refund of the policy or to put it another way, you don't ge a Plevin refund AND a policy refundSam Vimes' Boots Theory of Socioeconomic Unfairness:

You can't make "just a Plevin complaint". Plevin is looked at if you complain that the policy was miss-sold and the lender doesn't agree but there was a commission element that they need to refund. As such, when you complain about the policy they will cancel it if it's still in place as you are saying you don't want the policy. FOS front line staff aren't necessarily qualified to advise on these technicalities and may simply say what they think you want to hear or so onSam Vimes' Boots Theory of Socioeconomic Unfairness:

RBS have advised I can just make a plevin complaint. I’m confused now0 -
Hi Nasqueron
I haven’t made a complaint against my Barclaycard if you read my posts, because it was not mis sold.
You can make PPI Commission complaint without making a complaint against ppi as Barclaycard have told me so and there’s a link on their website to do just that.0 -
Hi Ladyinwaiting,
Don’t be confused. What the FOS has told you is correct, you can make a complaint against only the PPI Commission (Plevin), that’s as long as you haven’t had a successful PPI complaint already paid out by them, Nasqueron is wrong in what they said.0 -

I’ve done the same with RBS - also through a link on their website which allows you to raise just a plevin and not a mid sale complaint r. Hope you get some good news from Barclaycard0
