Leasehold management problems

Hi

Does anyone know anything about leasehold properties? I having a few issues and I could really use some help.

My flat is leasehold and someone is trying to replace the management by manipulating the other leaseholders. He apparently is representing 8 other leaseholders and has there votes. It puts a lot of power in his hands..

I could use some advice because I'm concerned that if the full service charge is demanded all at once I won't be able to pay it and be in breach of the lease (I'm currently paying monthly)

I kinda hope here that things are not as serious as I think and I could really use some advice from someone who actually knows about these things.

    Presumably "someone" is another Leaseholder in the block who is trying to persuade the Leaseholders to exercise Right to Manage.

    Have you spoken to this person to find out what the intentions are?

    Service charge is due when the Lease states. You are putting yourself at risk no matter who the appointed management company are if you are not paying on time. Presumably one of the aims of getting RTM is to reduce the service charges so this may actually help you get on top any arrears.

    What does your lease say? Does it state you must pay:

    * monthly in advance
    * quarterly in advance
    * annually in advance
    * something else?

    Assuming it says annually and you are currently paying monthly through some informal agreement, this is at best uncertain and could be changed at any time.

    I suggest you strat putting some money aside each month. Any change will not result in you paying more - just at a different time, so prepare for this just in case.

    As for the tactics, well, it sounds like a group of leaseholders are looking to implement RTM. And one individual is coordinating this. Generally that is a good idea and may well result in you paying less in service charges (no management company's profits to meet!)

    No and that was a mistake. He causes so much conflict that I don't want to talk to him. He also gets wound up so easily. He may well genuinely want improve things but it's the way he goes about it.

    We are having a meeting to discuss and I will talk about it then. Hopefully I can encourage some sane rational thinking.

    He isnt a leaseholder, he's the owner of a company that was managing the building but pulled out because he wasn't in charge or words to that effect. He's now wants to get a new management company, director and secretary.

    Apparently the lease says that the charge needs to be paid in full in January but I will need to check this. The problem with that is the full service charge is 1200 I don't have that kind of money. I do need to put money aside but it'll take time.

    RTM does seem to be the way forward and I will bring that up at the meeting we are having next week.
