Is delaying inheritance until 65 so that it doesn't inflict on benefits allowed?

If solicitors are dealing with the estate, their fees will come out of the estate.
If one beneficiary wants the solicitors to keep dealing with this, then the beneficiary's pay out will be reduced by the solicitors' fees.

He's got the option of taking the inheritance now and accepting the reduction to his benefits or continuing to refuse it until his state pension kicks in when he could find himself with a bill for all the overpayments and a fraud conviction.0
