Gladstones / uk car park management

Before anyone jumps at me for posting , I have read the newbie thread and followed to advice for posting a defence online but i have a couple of questions. Apologies for the length of this.


Back in sept 2017, the car in question was parked in a car park where you have to get a ticket for 4 hours of free parking.


My brother in law received the PCN and we returned the paperwork accordingly with the transfer of liability completed. We also mentioned that we had the ticket and was infomed that if we sent this off with the TOL the ticket would be rescinded.


We received a formal demand a few weeks later requesting payment and again i explained that they had the ticket and PCN and that it should be cancelled. This was confirmed by the phone op at UKCPM. I heard nothing more from them.



We then got 3 demands over 3 months from Debt recovery plus, who I again explained the situation to, sent off all the emails with the paper trail and who I spoke to and who clarified that it should be cancelled, they did say they would contact them and get it resolved. The last paperwork I received was in Feb 2018.


I presumed that due to this timescale I had been resolved.



On the 17th Sept 2018 we received a letter before claim from Gladstones. I phoned them and explained the whole situation again. They informed me i had to contact UKCPM again to get it sorted out.


Again I phoned them and explained who I spoke to , what was said and what paperwork was sent off.

They agreed that they had received the paperwork but the call recording only lasted 6 months and the person i spoke to no longer worked there but had worked there. This was a 'senior' manager.

They also stated that when i sent the ticket to them there was no return address so couldn't write back and confirm it.

(I find this odd as they had by TOL, reg no and also had the right address to send to Debt recovery plus and Gladstones)

After this conversation they did tell me that as it has gone on for this long I should have chased it up, they cannot do anything nor would they do anything.
Now I'm not legally trained but I'm sure UKCPM are making a claim and therefore, as the claimee, can instruct Gladstones to cease.


I then phoned Gladstones again who agreed that UKCPM can call them and cease all action but I would have to speak to them first to get this done.


So finally i called UKCPM and basically was told they wont do anything, they have more pictures than the one from distance and blurred image on the PCN, my ticket wasnt displayed and will see me in court







So my question is:



The ticket is in my wifes name but I am doing all the legwork. If this does goto court there is no way she would attend and they would win. How do I go about defending this myself on her behalf?


and what should I do next? I'm going to wait for them to want the case transfered and then get it local but it's the defence part Ill have trouble writing. Basically it's as above
