Lease car written off by Waitrose delivery van

Hi Jonesya
When I discussed this with Leasys they said that there would be no partial refund of the initial payment as that’s not classed as a deposit but just part of the finance deal to reduce the monthly costs ....
Apparently, had the car been written off the day after I’d taken delivery they would still not have issued any refund on the initial payment.
The three solicitors I’ve spoken with all said that regardless of how John Lewis settle with the lease company, I should not be left in a worse position as a result of the accident and so they believed I had a case.
One of the solicitors was a “no win, no fee” and I’m meeting one of the others next week for an initial consultancy so I’ll see where I go after this ...... worst case would be to go with the “no win, no fee” option but as they retain 25% of any pay-out I’d rather avoid that.
It’s all just very frustrating as depsite chasing both Leasys and John Lewis / Waitrose for feedback this week I’ve heard nothing, so Im in limbo at the moment regarding replacing the car.0 -

Did you take out any GAP insurance for the upfront costs as this is where you would have recovered this cost from.0 -

Also, he would've had to have taken out specific contract hire GAP insurance with added protection for the initial payment/deposit.0 -

OP had GAP insurance but this will only cover any outstanding finance and return OP to the position they were in before purchasing i.e. no car/no payments. AFAIK no-one is going to offer the OP a continuation of the deal they had so a rethink of cars within budget is likely to be needed.
And OP - I've benefitted from a similar Alfa introductory lease deal in the past and you're unlikely to get anywhere close to it a year down the line on the open market - it's a way of ARUK getting cars on the road in front of people0 -
I had GAP waiver included with the lease, so covered for any shortfall but nothing else.0
