I would focus on a SAR reply in order to get those docs and pics and evidence, if you have not done so, plus an ICO complaint if PP fail to issue them under the GDPR

I would also ensure you have any evidence of your own like signage etc, anything to help your case , even a SAR to the DVLA if that is required

then read up on what people like CM , BARGEPOLE , JOHNNERSH and LOC123 plus others have posted about court cases

also read other completed court cases with their comments on how it unfolded and what happened on the day

I have now submitted my defence (a little earlier than I would have liked, there was a mix up with the CCMCC but their staff have been very plain-speaking and helpful.)
I am just a little concerned that you mention the County Court Money Claims Centre.

Did your claim come from there?

Or did it come from the County Court Business Centre in Northampton?

Anyway, as you have been speaking to the CCMCC, I am sure your Defence will end up at the right place.
  • Thanks all, the help of this board has been invaluable and you guys should be nationalised as independent consumer advisors. :T

In my email to the Claimaint I have highlighted that I consider my request for documentation a formal SAR. (Athough I believe the GDPR guidelines specify that a SAR would be prompted by any informal request from a data subject?) Still, I can't expect actual compliance from these bloodsuckers, so it's better to be officious for the record.

The claim did come from the CCMCC. No unexpected worries there I hope?

    I will begin studying immediately.

No worries, we just don't often see a Salford claim. Were you able to email your defence?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Yup. Defence is emailed and I received an automatic reply which is reassuring. (I didn't for the AOS, and was advised by CCMCC to submit my defence when it (the AOS) hadn't been processed the working day day after it was due - that's the mix-up I referred to before.)

No worries now though, phoned them this morning and the AOS is in. It's a shame I don't get to refine the defence based on any further evidence, but I'm pretty confident that even a quarter will be enough to expose these vultures.
  • Hi everyone,

Many thanks for all the help I received here. I recently received the court directions from the good Judge and he specified that unless the Claimant got their act together, the claim would be closed and I'd get my costs back. As you'd expect; the weasels waited until the day after the deadline for submitting evidence, then pulled their claim - citing an administrative error and staffing changes. (Ha. Ha.)

Sorry for my terminology; it's been a while since I brushed up on CPR, parking, and this forum. I just wanted to say thanks, and to query if the claimant (Premier Park Ltd.) have been up to any more cheekiness? For the next few weeks/months (whilst I retain passion in this noble cause) I will happily help fight those cocksuckers for what they tried to do to me. Just to note that they acted VERY much against the spirit and requirements of CPR etiquette throughout.

Also. This claim contributed significantly to mental stress that had me seeking therapy and taking time/holiday off work. I'll do my own research but can anyone tell me what I can do with that? I genuinely racked up a lot of fiscal costs to fight these guys alone (unrepresented litigant - no law training at all) and want to get as much back as I can. Vaguely recall a thread about the costs; and I'll have a look now. Let me know what I can do for the forum, if anything. I'm happy for full disclosure about the entire process if possible. (Practical, mental, emotional.)

    CHEERS

Very pleased for you that you won but it is better if you start your own thread and give us a few details about the car park, PPC etc.
  • Thanks Le_Kirk,

What CAN I say legally? I would just like to give exact information about everything that happened and how the claimant behaved. I came close to paying the money at a few points because of stress and I really believe these parasites take advantage of people like me/my family (less economically/legally privileged.)

More than anything I'd like to give confidence to people who might be in a similar situation and make it more manageable for them. Because of the Claimants' behaviour I did a LOT of work learning CPR and case law, when the !!!!!!!s pulled out anyway. I'd like other people to know that they can just rely on them to give up, despite their fierce words.

    Thanks,
    Matt

In which case, my advice still stands, start a NEW THREAD and put your story to the forum.

You can say anything that's is honest and doesn't defame the other party.

As pointed out it would be much better in its own thread where it would attract more attention.
