Default date

Hello,

I had a Three sim only 1 month contract back in 2011 (being young and naive I didn’t know I needed to give in notice, completely my fault) so I ended up defaulting. I settled in full late 2016 once I was aware.

The debt was sold on to Lowell in October 2014 where they put a default date of 19th April 2013. The final payment was on October 1st 2012 and the FCO guidelines state an account should be defaulted within 3-6 months of being in arrears. I did complain to Lowell via resolver and they basically said it’s just guidelines but also said...

“As we are legally obliged to accurately reflect how your account has been conducted we would not look to remove or alter the Default.”

The second thing is, the only data showing is the data from October 2014, nothing from 2011 to September 2014 showing earlier payments being made at least. If they’re playing the obliged to accurately report card then surely they should be actually accurately report the whole account? Only reporting half the account isn’t accurate especially when it’s the negative half.

They claim it was Three who defaulted the account but as far as I can see, Three had never reported anything to my credit file. Being back in 2011 and a 1 month sim maybe they didn’t see fit? I’ve attached a screen shot of my credit file. It’s reported the same across all the CRA’s. The account only shows updates from when Lowell had bought the debt in October 2014 and have put a slightly harsh default date.

Is there anything I can do to get the default date changed within 3-6 or have them report the whole account accurately? Would the financial ombudsman be of any help?

  • Is it worth your time complaining? After all, the defaulted credit account will be removed from your credit file history in April (just five months time)!

  • Nothing needs amending here - all is fine and the default/entry will drop off your files in April 2019
  • Thanks, just wanted to double check incase I could get it removed a bit sooner.

    I’m looking at buying a cheap ish property in Budapest any day now after January 1st (I spend half my time here for work and half back home in the U.K.) so chances are I’m going to need a loan to furnish the place and carry out a few repairs/improvements to put my mark on it. The months I’m not there I will look into renting it out via air bnb using a local company to over see everything.

    The only thing really holding me back is this default hence I’m eager to get it removed ASAP. Despite having credit cards since late 2016, never missing payments, paying in full etc the only loans I seem to be eligible for is a handful at 30% or guarantor loans at even worse rates and there’s no way I’m putting anybody in the position to be a guarantor for me even if the rates were reasonable.
