Court date and Parking Eye

Hi All,
I have my court date with Parking Eye on 23rd Nov. Basically, to cut it short, I was in the car park and have never denied I wasn't, I did however, make 3 attempts to pay at the machine but all three times, nothing came up for me to pay. I even asked a car park worker if the machine was working, he just said it was nothing to do with him. I filed my defence, that the onus should be on the company to prove no attempt was made to pay. They only have cameras on the entrance and leave points of the car park, so no cctv, to show my attempts. If I had not paid just for sake of not paying, believe me I would have paid it. It is more about the fact that I did attempt to pay and as I knew I was there or there abouts for the time stay, I genuinely thought I didn't have to pay. So, here I am, only problem is I cant take the time off work to attend the court. Will this go against me ? I would hope not as that wouldn't make it fair would it ? But don't want to get this far down the line and have to pay it just because it goes against me because I cant attend. Any thoughts please ? Does anyone have any idea what or how I word the letter to court for being unable to attend. Thank you

Is this a new case or to do with your other threads? If new, a bit more detail would be appropriate. If it is a continuation of a case, then you should keep all your posts in one thread. Just send a PM to Crabman, Savvy or Soolin and ask one of them to merge your threads. That way posters don't have to search all over the forum for details posted earlier.0
