Transfer of part

Wondering if anyone can help.

We are part way through purchasing a house (still early stafes) and its come to light that there needs to be a transfer of title. Long story short, local landlord is selling a house he built using part of the pub garden, as he was initially renting it out it wasn't an issue, now he's decided to sell, it turns out that property isn't registered separately from the pub so this now has to be done
Anyone an idea of how long this takes?

    You'd like to assume that the vendor's solicitors are getting on with that in parallel to your purchase enquiries, so it shouldn't add much - if any - time to the purchase.

    But, then, you'd like to think they'd have thought about it first...


    In short, it depends entirely on how quickly they get on with the paperwork.

    They did, hence why they never registered it in the first place....wonder if they have ever paid council tax on the new build property.....I would be making sure your solicitor gets their bi-noculars out on the all the paperwork, planning permission, building regulations, expect to pay for indemnitys for anything and everything.

    Completely pointless to separate the title if they were just renting it out.

    New Plans woll need to be drawn up for both the existing Title (which he is keeping but which will be reduced in extent) and the new Title being sold.

    This may need (probably will?) a surveyor and /or Land Registry may decide to do a site visit to verify the Plans.

    How quickly LR deal with it will not just depend on their backlog, but on whether they accept the TP1 and accompanying documents and Plans, or query them.

    Yeah they're sparkly ones I wear on my show shoes...!
  • I've spoken to Devon Land Registry today, they've advised process should be 53 working days, or if expedited service is used 10days. Assuming all papers are in order or no issues as such.
