  • It would seem they haven't received my defence. I've emailed it over to them again.

Just as an update CEL have sent me a notice of discontinuance on Wednesday. Moneyclaimonline isn’t however showing anything yet.

It's quite a while since you last posted richardadc.
I imagine your case was assigned to your local court some time ago.

MCOL plays no part in the process, and is therefore not updated, after the claim is passed from the CCBC to a local court.

ANOTHER ONE BITES THE DUST! :T

Sadly it now seems I may still have to turn up to court. The court enquiry line are still saying the case is due to take place on 6th August which is the day I also have a hospital appointment for my son.

I've phoned CEL and they have confirmed that they have discontinued the case and will send another email to the court. However the court is 56 days behind so I imagine that's not likely to help the matter.

I also haven't submitted a witness statement and neither have I received one from CEL. The court enquiry line also can't confirm if CEL have have paid the trial fee.

What a mess! If anyone can offer any advice it would be much appreciated. To miss my son's hospital appointment when it seems like the case shouldn't be going ahead anyway would be devastating.

I'm also thinking of turning up to court tomorrow morning to see if i can speak to anyone. The enquiry line is based outside Chelmsford County Court so it's not possible to speak tot hem directly over the phone.
  • I've sent an email to the court with a copy of the letter sent by CEL discontinuing the claims and also proof of a hospital appointment on the same day.

Anyone any ideas on how to proceed with the above?
  • Final update:

The court confirmed the trial fee wasn't paid by 9th July so the case was struck out. I will receive this in writing some time in the future.
