    So you dont have their WS yet? Why haven't you chased it? Dies the court have it?

    no need to take print outs as long as you're SURE the court will have pr8nted it all out. Have you confirmed that? 
    Yes I do have their witness statement - that was the last thing they sent me back in Dec 2019.
    I will check with court.

    Court hearing was listed for today. We attended but Gladstones didn't send anyone and hadn't notified us or the court of their intention not to attend so judge read out a couple of legal clauses and struck out the case without any evidence being heard. I thanked him. I asked him about expenses but he rather curtly replied that the case was struck out and we were free to leave which I interpreted as "you don't have to pay the fine, they don't have to pay your costs, clear off !" so we departed. He did indicate the case may be re-opened if the claimant appeals although it would seem unlikely to me given that they didn't turn up the first time. Not sure why Judge was quite so abrupt with us and sharply dismissed my query about expenses, he clearly wasn't in the mood to entertain any further discussion with me so I left it at that and we had got what we went for which was to have the claim struck out. Spent barely 5 minutes in the courtroom. Feels like a considerable waste of time and effort given the incident was 2 years and 2 months ago but glad we don't have to pay the PCN. Thanks to all of you for your assistance throughout. How long do Gladstones have to appeal the outcome ?

    Good news

    A judge who is not user friendly happens is not often and of course he should have awarded costs.

    You won and the incompetent Gladstones scuppered themselves. they do that

    The judge ?? well, maybe he did not get his oats last night

    Maybe 'Costs' would have been a term that could get a bit more traction - but who knows. Take some level of revenge ......

    Well done!   Some Judges are very anti costs.
