PCN Received

Hi All,

I've had a quick look through the NEWBIES thread, but cannot seem to identify what I'm looking for?

I've received a PCN in the post, with one not being affixed to my car.

My car is a lease car through work so they've paid it already and we appeal afterwards.

My question is over the legality of the ticket, does one need to be served on the windscreen to be valid? Or can they send you a PCN in the post?

The company in question is CPM UK Car Park Management.

    if your firm are stupid enough to pay it then I cannot see how it can be appealed afterwards, more fool them for paying it

    These private parking tickets are invariably scams, a similar transgression in a Council car park s likely to cost you considerably less.

    See what MPs think about tthis scam.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future..
    You never know how far you can go until you go too far.

  • Hello all thanks for the advice.

    It's normal company policy with LEX apparently, they pay all fines but give us an authoritive letter confirming that the 3rd party wishes to contest it.

    The incident date was the 15th October and the issues date on the letter is the 30th October.

    Am I right in saying they are outside of the 14 days, or do they have 30?

    But does the lease cover private parking charge notices? If not specifically mentioned in the lease contract then they are mugs for paying the scammers. They have also denied you the opportunity to appeal this as day to day keeper.

    As above, I don't see how you can subsequently appeal once the PCN has been paid by the idiots at Lex. I think you should now check to see if Lex are members of a trade association such as the BVRLA, and complain to both them and Lex that they have paid a scam invoice and unlawfully billed you for their stupidity.

    You should also complain to your MP about this unregulated scam.

    If ANPR was used then the scammers have to get the NTK to the keeper (Lex) by day 14, the date of the alleged event being day zero. In this case, Lex were never liable and should simply have told the scammers the hirer's details to absolve them of any liability.

    If a windscreen ticket was left then the dates are different, but you would have dealt with this yourself and Lex would never have known about it.

    OK, but what is the company policy with regard to speculative invoices?

    There is no fine here, just a speculative invoice.

    Does your company pay all invoices, whatever they are, and then try to claw back funds later when they realise they should not have been paid?
  • I believe it is LEX that pay the fines automatically - our fleet department then send us the PCN in an e-mail along with a letter from LEX confirming they've paid the fine in good faith however hte keeper/drive (not sure which wording) wishes to appeal the ticket.

    Poor admin on my side/being busy means I am way out of depths on appealing this on normal 30 days requirement etc.

    To clarify I was never given a windscreen PCN but received a postal PCN although it was not ANPR cameras, a warden has walked round and snapped my car but decided against given a windscreen PCN.

    the EDNA BASHER ADVICE includes info on the time periods for LEASE VEHICLES, where POFA2012 is concerned


    it also has advice on what should be included with the NTH (Notice To Hirer) and so if you as lessee have received an NTH or INVOICE for this pcn then you should appeal it according to the EDNA BASHER advice


    that advice is the best advice you can get on hire or lease vehicles, because he deals with them regularly


    the fact that it has been paid may not matter if there is an agreement in place, but it sounds far fetched to me

    A problem is that you are still referring to these unwanted invoices as fines.

    Please believe me when I say that it is not me nitpicking. The lease company may well have different T&Cs for dealing with fines and charges. So if you talk about fines to them they will quote you the T&Cs concerning fines, whereas their T&Cs concerning parking charges could well be different.
