Its a faceless forum so people find it easier to be mean. Its just the internet.
As for your issue i suspect the easiest way to resolve it would be to get one of the appropriately coloured scratch (touch up) pens you can buy.
From a legal aspect there could be an argument that you touched it last therefore some of the liability lies with you. In terms of suing someone, its avenue you could pursue. Itll cost you money and effort and only really worth doing if youre certain of blame. That said there things that need to be done to mitigate going to court, i usspect thats where the touch up pen would come in. Failinggoing down the court route you can claim of your insurance. THis is where you should be looking really, in effect its no different than a tree from theirs blowing down or a roof tile coming loose in bad weather. End result is it would be you having to claim on your own insurance policy to recover losses, most people have an excess which is going to put you back in the realms of buying a scratch pen.
Long and short of this its just not worth your effort trying to force them to solve the issue, by all means point out whats happened point out the damage but if they arent forthcoming with an offer to sort it, its not going to be worth the hassle making them. Just by a scratch pen and keep it handy if theres a next time.

She hasn't been home, and the other rope came loose 5 days ago and she never bothered to the it back up, walked past in blowing all over the place, why the hell would I tie it up if she couldn't give a toss.0

Spadoosh thank you for your reply, I don't really post on forums so I'm not used to the out and out bullying that seems to happen, if people don't have anything of contribution to say then stay quiet, same goes for sarcastic comments about "First post" really guys? Is that how you get off? I'm not bothered about suing her it's more the fact it's been blowing about for 10 days and now it's come loose and scratched my car, more the fact I need her to see her negligence of her property affects other people, like her rattling her door handle between 30- 50 times every morning at 5.50am, having a party at the weekend until 5.am, going away for 3 days at a time and leaving an alarm clock going off inside every 30 minutes0

And as for moving it back and being the last to touch it, it would have blown back eventually anyway seen as it was swinging around like a pendulum, next time I'll let it damage the other neighbours car but then I'll be in the wrong for doing that too!0

No you won't, not legally anyway, although your neighbour might be a bit miffed if they find out you know it was loose but didn't tell them.
As for your complete overreaction to being told what we believe the legal position on responsibility to be, if you don't like it then feel free to pay to consult a solicitor.0 -
