Recovering small costs after rejection.

Hi to all,

I have just today agreed with a main dealer to cancel a finance agreement on a car I purchased 12 days ago so within my 14 day cool off period and they are planning collection of the car. The reasoning for rejection is that they are unwilling to carry out paintwork repairs that we agreed to have rectified in writing in the form of a headed and signed letter from them stating that they will pay for the repairs to be carried out at no cost to myself. They claim the costs to high for them and the end result is rejection/return. I was happy to keep the car if the repairs were done, they are unwilling to pay for them...

What are my rights as the reclaiming costs incurred by myself due to rejection as a result of their unwillingness to complete on the agreed sale terms. I will add at the time of collection I said I didn’t want to complete on the purchase due to these defects hence the letter stating they will rectify them.
I have taken time off work to obtain quotes for the repair, paid for insurance on the car which will now have to be cancelled and incurs cancellation fees and the cost of taxing the car which is non refundable.
All I have asked for is the cancellation costs and the tax costs to be covered but they are unwilling to pay? The costs maybe fairly small but am I wrong for asking to be returned to a financial state I was pre purchase considering they are the ones not willing to complete as agreed? If I was to include the cost of my time on a days leave from work the costs would be much greater but I was able to use the day for other means around waiting for quotes.

    Are they supplying you with another car?
    How much out of pocket costs are you looking for?

    I suspect you won't get very far asking for those costs, their contract only covers the car and they've returned you to your original state in that respect. You might be able to get some good will out of them on the next car via extras or servicing.

    You can always write a Letter Before Action to see if they fall for it, but realistically the legal route will cost you much more in time and money than you'll get back so you're as well chalking it up to experience (don't collect the car until happy) and moving on.
