    Well in that case - surely you can turn round and say to all concerned "If it ain't in the deeds that you can do it (ie walk through my garden) then that means I have no legal obligation to let you walk through my garden"?

    I know this was one thing I had to do on my place - take the attitude of "If it ain't in the deeds - it ain't happening".

    Are you sure it would be your land? I don't see the point if you can't use it for anything. Would be simpler just to shift the boundary, unless the layout isn't as straightforward as I'm imagining (yes, a diagram would assist!).

    That's what I thought, although I'd try for a price reduction.

    I'm envisaging that this walkway runs at the far end of the garden, rather than through the middle, or any other inconvenient part. If so, it's a matter of losing a metre or so of garden; annoying but maybe not a deal-breaker.

    Have a look at the planning as well could just be an error.

    WE have similar(also persimmon) when you look at the plots you could think the land between the houses one side belongs to next door but it mostly belongs to ours and we have a gate into the back, they have a 2ft(ish) strip

    on the other side we have the 2ft(ish) strip and next door owns the rest with a gate into their garden

    The boundary marker is the fence post and runs parallel to the house walls forward to the road(no actual fence in front of that line)

    this is all at the front so not a big deal.

    crazy layout of that estate
    No 2 also has No 1 parking along side it and has to go the other side of No 4 for theirs.

    if they had nudged them up a bit No1 get parking along side as would every one else No 5 losses a bit of garden.
